Date: 6 Jun 04 LAW ENFORCEMENT SENSITIVE CID Form 94 DODDOACID-005496 Basis for Investigation: This investigation was initiated based on notification from the 22nd MP Battalion, of possible detainee abuse in various locations. On 6 May 04, Mr. [deleted] CACI, 1st Cavalry Division Interrogation Facility, Baghdad, IZ: was interviewed by [deleted] (NFI) and stated the MPs were not following instructions on the treatment of one of his sources and would harass him. He heard [deleted] shaved the beard of a detainee. Mr. [deleted] stated he heard there was possible abuse Al Azimiyah Palace (NFI), where 5th Group conducted their interrogations. Mrs. [deleted] related he never witnessed any abuse occur; however, he heard [deleted] (NFI) describe a technique where he would circle the detainee's nipple with a cigarette but never touch it. He said [deleted] was currently at the Tikrit Division Interrogation Cell (NFI). On 8 May 04, Mr. [deleted], CACI, 1st Cavalry Division Interrogation Facility, Baghdad, IZ, was interviewed by [deleted] (NFI) and stated he overheard [deleted] (NFI) say he shaved a detainee's beard and put women's red underwear on him. Mr. [deleted] also stated he heard a detainee was shot in the head with a rubber bullet. Mr. [deleted] related he heard unidentified individuals tell the MPs to "soften up" the detainees. Mr. [deleted] further related certain individuals took copious notes and may have more information. He identified them as [deleted] (NFI) and [deleted] (NFI) both located at Abu Ghraib Prison, Baghdad, IZ. About 1130, 12 May 04, SA [deleted] interviewed Mr. [deleted], CACI, 1st CAV Division Interrogation Facility (DIF), Baghdad, IZ, who reiterated his initial statement. Mr. [deleted] stated he worked in approximately three sections, while at Abu G. Prison, which was the screening section, Interrogating with Tiger Teams, and the Detainee Assessment Board. Mr. [deleted] worked at the Abu G. Prison between Sep 03 and Apr 04. Mr. [deleted] never seen any detainee abuse, but stated he saw the results of abuse, which the detainees would describe to him during the initial screening phase, i.e. wounds to their chest possibly from battery cables being connected to their chest, electrocuting, cigarette burns, wine bottle placed in their anus. When Mr. [deleted] questioned the detainees about who abused them, they stated U.S. soldiers and [deleted], but unsure of the incident location. The detainees, while bags over their head described the U.S. soldiers only by observing the typical desert combat boots and pants, but did not provide any further details. When Mr. [deleted] abused them he would remove the bag from their head. The detainees never described Mr. [deleted]. Apparently, Mr. [deleted] would wear different types of clothing to include military clothing. Mr. [deleted] reiterated Ms. [deleted] (NFI) took notes on what she observed and heard, while at the Abu Prison. Mr. [deleted] suspected a Task Force4 was working with Mr. [deleted] at a Palace, unknown location, but could not provide any details. Mr. [deleted] also mentioned Ms. [deleted]'s roommate, Ms. [deleted], translator, Abu G. Prison, would possibly have further details of possible detainee abuse. Mr. [deleted] stated a medical doctor, Abu G. Prison conducted physical exams on the detainees, usually on the second day of in-processing, so the medical unit would possibly have copies of their treatment records, revealing any injuries. No further details were provided to this office. About 1138, 12 May 04, SA [deleted] interviewed Mr. [deleted], who stated he was interviewed by MAJ [deleted] who discussed possible abuse allegations which he related he had no first hand knowledge of. He stated Mr. [deleted]'s statement he overheard could have been taken out of context because he did hear the whole conversation. He stated SPC [deleted] (NFI) was the person who gave specific orders to the MPs to not harass his source. Mr. [deleted] related Mr. [deleted] possibly shaved the detainee's beard for several reasons to include identification purposes or sanitary purposes. He was unaware of women's underwear being placed on the detainee. Mr. [deleted] stated Mr. [deleted]; Linguist, CACI, 1st Cavalry Division, APO AE 09342, interviewed a detainee who alleged he was abused while at AL-Azimiyah Palace. About 1230, 12 May 04, SA [deleted] interviewed Mr. [deleted who stated he was the primary interviewer for Mr. [deleted], Military Police, Number [deleted]. Mr. [deleted] related Mr. [deleted] was captured on 4 Apr 04 and was brought to their Detention Interrogation Facility (DIF) on 29 Apr 04. He related Mr. [deleted] alleged he as taken to the Al-Azimiyah Palace and was struck in the face several times by whom he believed to be an Iraqi named [deleted]. He said he believed the man to be Iraqi by his dialect and appearance. He stated he was wearing a bag over his head during the interrogations but [deleted] removed his hood once and looks at Mr. [deleted]. He knew his name to be [deleted] because he heard another man he believed to be Iraqi call him that once. Mr. [deleted] told Mr. [deleted] [deleted] burned him with cigarettes on the foot three times and struck him on the left side of his head so many times he bled from his ear. Mr. [deleted] stated he had no bruising on his face or fresh burn marks on him to substantiate such allegations and was given a medical exam when he was received. He related Mr. [deleted] was in Al-Azimiyah Palace for approximately 18 days. He related Mr. [deleted] was a Major in the old Iraqi Army and was incarcerated twice for dereliction of duty and spent a year in prison under the Old Iraqi regime. Mr. [deleted] stated Mr. [deleted] had trouble discerning his current incarceration from when he was incarcerated under the old regime. Mr. [deleted] further stated Mr. [deleted] faked a heart attack on 4 May 04. Mr. [deleted] stated he coordinated with two individuals at Al-Azimiyah Palace, [deleted] (NFI) and [deleted] (NFI) who came to the DIF location and positively identifed Mr. [deleted] as the person they interviewed and brought the interrogation reports which verified the interviews. Mr. [deleted] related the men said they refuted the allegations made by Mr. [deleted] and Mr. [deleted] could not explain his story when confronted by Mr. [deleted] with the reports. He related Mr. [deleted] just gave him a look he described as he was just caught in a lie. Mr. [deleted] provided this office with a photograph and medical evaluation of Mr. [deleted]. (See documents) About 1328, 12 May 04, SA [deleted] reviewed the medical records on file of Mr. [deleted] which reflected an incident when Mr. [deleted] faked a heart attack. Nothing else remarkable was seen. About 0930, 15 May 04, SA [deleted] and SA [deleted] interviewed Mr. [deleted]. [Deleted], AKA [deleted], Interpreter, 1st Cavalry Division DIF, Titan Corporation, APO AE 09342 who stated he was the interpreter for Mr. [deleted] when Mr. [deleted] was interviewed. He reiterated what Mr. [deleted] stated in that Mr. [deleted] related a man he claimed to be an Iraqi abused him when he was detained at the Al-Azimiyah Palace. Mr. [deleted] stated the man's name could also have been [deleted]. Mr. [deleted] related he was not familiar with [deleted] and has not heard anyone mention hsi name. Mr. [deleted] further related this was the only detainee he talked to which mentioned being abused in the Al-Azimiyah Palace. Mr. [deleted] stated sometime in Aug 03, while he was working in Abu Ghraib Prison, he witnessed a female soldier he believed to be U.S. Army Military Police, make a detainee jump up and down and then roll left to right on the ground in what he believed to be 150 degree Fahrenheit temperature clothed in only his underwear. He stated this went on for about twenty minutes and the detainee was at the point where he collapsed several times and when the detainee attempted to drink water he would vomit. Mr. [deleted] related he knew the female soldier's first name as [deleted] (NFI) and she always worked with an interpreter named [deleted] (NFI) who was also employed by Titan Corporation. Mr. [deleted] stated Mr. [deleted] would know exactly who [deleted] was and would be able to give more details on this incident and possibly other incidents. About 0900, 20 May 04, this office received the final Information Report from the Baghdad Correctional Confinement Facility (BCCF), Abu Ghraib, IZ, APO AE 09342. The report included the AIR from SA [deleted], which detailed the interviews of Ms. [deleted], Ms. [deleted] and Mr. [deleted]. (See AIR for details) About 1015, 20 May 04, SA [deleted] and SA [deleted] of this office interviewed Mr. [deleted], date of birth [deleted]; Place of Birth [deleted] [deleted] [deleted] [deleted] [deleted] [deleted] [deleted (NFI) with assistance from Mr. [deleted], Linguist, Titan Corporation, 1st CAV Detention Interrogation Facility (DIF), Baghdad Inernational Airport (BIAP), Baghdad, IZ, who reiterated his previous statement he provided to Mr. [deleted] on a prior interview. Mr. [deleted] also provided additional details. Mr. [deleted] described [deleted] (Iraqi interrogator) as a white male, combed, gray hair, no mustache, light white beard, who wore a white t-shirt, brown trouser, sneakers, and rubber gloves. Mr. [deleted] stated after he was apprehended from his residence he was moved to three different locations: 1) Alazamiya, Baghdad (where all the abuse took place), Unknown location, Taji, IZ, and ICD DIF. While at Alazamiya, (Underground room) Mr. [deleted] had his hood pulled off his head, so he could see the interrogators were Iraqi civilians on several occasions and replaced back on his head. Mr. [deleted] was handcuffed to the floor in the underground room. Mr. [deleted] was interrogated on approximately five to six occasions. The abuse by Mr. [deleted] toward Mr. [deleted] included pinching his nose while pouring water into his mouth; stuck a wooden stick up to his anus region, but as they touched his anus, Mr. [deleted] told Mr. [deleted] he would tell them anything and sign any documents. Mr. [deleted] also had a wooden stick jammed between his testicles and anus region and also had his testicles electrocuted. Mr. [deleted]'s head was hit by Mr. [deleted] on several occasions. Mr. [deleted] was a smoker and also burned Mr. [deleted] on the ankle with a cigarette. Mr. [deleted] had never seen or heard of Mr. [deleted] (NFI) abusing him, but did see him present during the interrogations. Mr. [deleted] drew a picture of the Alazamiya location. (see picture for details) Mr. [deleted] had never seen or heard any American Soldiers during the interrogation, while at Alazamiya location. Mr. [deleted] was then transported to an unknown location, Taji, IZ, where he was treated well by the American soldiers. The American soldiers brought him bread, water and took him to the restroom on many occasions. Mr. [deleted] received a medical screening, while at an unknown location, Taji, IZ. Mr. [deleted] was then transported to the ICD DIF, BIAP, Baghdad, IZ. About 0955, 22 May 04, SA [deleted] and SA [deleted] interviewed Mr. [deleted], Interpreter, CJTF-7, Titan Corporation, Camp Slayer, who related he worked with SPO [deleted] [deleted], 205th BDE (NFI), and related everything she was doing was in accordance with the rules of engagement and never witnessed abuse of detainees while working at Abu Ghraib with SPC [deleted]. About 1730, 22 May 04, this office received statements in reference to Ms. [deleted]. Ms. [deleted], Mr. [deleted], Detainee NDRS# [deleted], Detainee NDRS# [deleted], Detainee NDRS# [deleted] from the 22nd MP BN (CID). The statements were unsigned and not dated. The statements allege abuse at various locations to include Al-Azimiyah Palace. (See statements) About 1300, 23 May 04, SA [deleted] of this office, and Interpreter [deleted] [deleted], Abu Ghruyeb CID, conducted interviews of Mr. [deleted] [deleted], NDRS # [deleted], Mr. [deleted], NDRS# [deleted], Mr. [deleted, NDRS# [deleted], Mr. [deleted], NDRS# [deleted] , Mr. [deleted], NDRS# [deleted] , Mr. [deleted], Muslim [deleted] NDRS# [deleted], Mr. [deleted], NDRS# [deleted] , Mr. [deleted], NDRS# [deleted] , Mr. [deleted], NDRS# [deleted], Mr. [deleted], NDRS# [deleted], Mr. [deleted], NDRS# [deleted]. All related they were at home when American forces raided the house, 0200, 24 Dec 03, in Slaikh Alrabee Neighborhood, Baghdad, IZ. American forces broke the front door and threw distracting devices in the house. After entering the house all the occupants' hands were tied behind their backs. All the women in the house were tied to the stairs in the house and the men were taken to the kitchen and they were all hooded or blind-folded. The detainees alleged the house was ransacked and approximately $80,000.00 US dollars and $30,000,000.00 Iraqi dinner were stolen. In addition to the money all the gold in the house and women's jewelry were stolen and the Americans broke all the windows in the vehicles and the furniture in the residence. Detainee [deleted] related he was hit in the head with a wooden object when they stormed the house and was cut and almost knocked unconscious. Detainee [deleted] stated he was hit in the head as well and knocked to the ground. When he was dragged into one of the HMMWV's he was kicked in the head. During the raid no one spoke to the Iraqi's and the house was inspected without anyone going with them. All the men were taken from the house to Ruthwania Palace. After they arrived at the Palace they were thrown to the ground and their hands were untied and replaced with handcuffs, which were put on very tight. Detainee [deleted] related his father was with him; however, his father was in poor medical condition and was taken to an unknown hospital. He related he has not heard about his father nor does he know what his current condition is. While at the Palace they were forced to kneel on the ground (stones) with their faces on the ground for four days and nights. When it was dark they were taken inside the palace and placed in the same position on the concrete floor. All the detainees stated they were hooded the entire time and were unable to see. Further, they were not fed and were not allowed to sleep, during those four days. When some of the detainees asked what they had done, they were kicked and punched on the head and back. Detainee [deleted] stated he was hit so hard he lost consciousness. During those four days at the palace the Americans released dogs on them; however, the dogs only bit their clothing and never caused any physical injuries. Detainee [deleted] also related that at one point he was being interrogated and the interrogator lifted up his hood and insulted him by threatening to shave his head and beard and make him wear woman's clothing. The interrogator also stated he was going to have sexual relations with the Detainee's mother. He described the interrogator as a white male with blond hair and a blond mustache, about 35 years old, with blue green eyes, about six foot tall and of muscular build, he was wearing an army DCU cap. Detainee [deleted] related he did not know if the interrogator physically assaulted him because he was hooded, except for the time when he was insulted by the interrogator. Detainee [deleted] related he lost feeling in his right hand because the handcuffs were too tight while he was at the Palace and he was kicked very hard in the right thigh. All the detainees related they were punched and kicked several times while at the palace. They also related the abuse stopped after they left the palace and they have all been treated very well since arriving at Abu Ghruyeb. They were asked as to why they had so much money in the residence, which they replied they are a wealthy family as they are in the transportation business with many busses and vehicles. About 1300, 24 May 04, SA [deleted] of this office and Interpreter [deleted] [deleted] Abu Ghraib CID, interviewed Detainee [deleted], NDRS# [deleted], who related he was the uncle of [deleted]; however, he was very poor and did not associate with the family. Detainee [deleted] related he was detained with his son's and one of his son's friends who was visiting. They were not with [deleted] when they were detained. Detainee [deleted] related the only thing he knows of that family is they are well respected in the community and provide money for the poor. He did not believe the family would do anything against coalition forces and that [deleted] had a man who worked for her who wanted to work for the coalition forces and she encouraged him to go and help. He also related that he heard Huda [deleted] and her sister and brothers turned themselves in because they wanted to prove their innocence. Detainee [deleted] stated he believed IP [deleted] was a bad man and tried to extort money from the family and when they refused, he captured and tortured them and brought false allegations against them. He denied any knowledge or involvement in attacks against coalition forces and did not know why he was detained, as the Americans searched his house and did not find anything other than one of his son's pistols. His son is an Iraqi Police man and was authorized the pistol and when the Americans came into the house he told them about the weapon and brought it to them. About 1420, 24 May 04, SA [deleted] of this office and Interpreter [deleted] [deleted], Abu Ghraib CID, interviewed Detainee [deleted], NDRS # [deleted], who related the same thing as his father and stated that he was tortured by IP [deleted] while at the palace. IP [deleted] informed all of the persons captured with him that if they made statements about [deleted] and her family they would be set free. Detainee [deleted] refused and was kicked and punched severely for several days. Detainee [deleted] stated IP [deleted] tried to extort money from [deleted] and she refused and that is why the family was captured. Detainee [deleted[ stated he knew [deleted]'s family although he was poor and they were wealthy he saw them many times and knew the family to be good people and not against the coalition forces. Detainee [deleted] related that he had a hernia surgery two days prior to being detained and was laid up in bed when he was detained. About 1530, 24 May 04, SA [deleted] of this office and Interpreter [deleted], Abu Ghraib CID, interviewed Detainee [deleted], NDRS# [deleted], who related he was visiting his friend, detainee [deleted] because he needed help after his surgery, when he was detained. Detainee [deleted] stated he did not know why he was detained and he did not know who attacks coalition forces nor has he ever attacked coalition forces. Detainee [deleted] also stated IP [deleted] tried to get him to make false accusations against [deleted] and her family and that if he did he would be let free. Detainee [deleted] refused and was severely beaten by IP [deleted]. Detainee [deleted] stated he did not know [deleted] or her family, just that they had a good reputation in the area for helping people in need and that IP [deleted] had tried to extort money from [deleted] and when she refused he captured her and made people give false accusations against her and her family. About 1000, 25 May 04, SA [deleted] of this office and Interpreter [deleted] [deleted], Abu Ghruyeb CID, interviewed detainee [deleted] who stated she was captured on 13 Jan 04. Her house was searched; however, nothing was found. She was taken to Kurkurk, where no abuse happened; however, she was later taken to a detention facility on BIAP, where a doctor checked her out. While at BIAP she was forced to stand against a wall for long periods of time, she subsequently fainted because she had not had any food for two or three days. She was later interrogated and she was accused of lying and she was placed in a dark room with loud noises from a stereo being played (the noises sounded like people screaming and crying). An unknown black female, US Soldier guard came and threw her around the room from one wall to the other until she fainted. The female stripped her down to her bra and underwear and brought her out so the men would laugh at her. The male interrogator told her he was the devil and he and the black female made her crawl around on her hands and knees for hours. The female would hit her with a long stick whenever she would slow down while crawling. The male guards would all laugh at her and the female would pour cold water on her as she crawled. The guards brought in her nephew and took off all of his clothes and made her and her nephew look at each other. The female guard exposed the detainee's breast and forced her nephew to look at her. The female continued to beat her while a male beat her nephew. They were again ordered to crawl on the floor and the female pulled her hair, to the point it took her breath away and slammed her head against a wall. If she tried to sleep the female would pour water in her ears to wake her up. The female beat her with a plastic chair until the chair broke. The detainee stated she had a plastic sliver in her foot, that she was not allowed to take out, which subsequently caused an infection in her foot. She was beaten against a wall until she passed out, and again water was poured in her ear to wake her up and the female threw her leg numerous times against a wall. Later the interrogator brought in a meat grinder and told her they were going to grind her up in the meat grinder if she didn't talk. A machine (believed to be a vacuum cleaner) was brought in to her room and she was told to clean up the room. The detainee stated she did not know how to use it and she was subsequently beaten with the vacuum cleaner hose on her face and nose. She was placed back in a small room with no lights and was given her clothes back after the clothes were soaked in water. At night when she tried to sleep they would come in and wake her up and not allow her to fall asleep and she was forced to stand. She was not allowed to use the bathroom and if she asked the female would beat her. The detainee stated there was a nice guard who allowed her to see a doctor who looked at her foot and gave her slippers to wear. She stated she saw the doctor at 0400 in the morning and the doctor pulled out the sliver. The doctor checked up on her two days later and changed the dressings on her foot. The detainee stated she was in the cell for five days until she was transferred to a batter place. She was taken to Abu prison where she received medical treatment for her injuries and given medication and she stated she has been treated very well at Abu prison. Detainee stated she believed she was going to be released soon and did not want this investigation to slow that process. Detainee provided a written statement (See statements) About 1000, 25 May 04, SA [deleted] conducted a search for a detainee, NDRS [deleted]; however, no record was found, that same number belonged to an Iraqi prisoner, who was arrested by Iraqi police and had nothing to do with attacks on coalition forces. In addition, the detainee with that number has been in custody since Aug 03. About 1400, 25 May 04, SA [deleted] interviewed Mr. [deleted], CACI Screener, [deleted], who provided a statement documenting his knowledge of suspected abuse detainees informed him of during his screening process. (See statement) AGENTS COMMENT: Mr. [deleted] related he informed his supervisor, Mr. [deleted], CACI Screener Supervisor, Abu Prison, IZ, of all Detainees who informed him of abuse. Questioned Mr. [deleted] who related Mr. [deleted] did inform him of all alleged abuse. Mr. [deleted] related he did not have any additional information than what Mr. [deleted] provided. About 1530, 25 May 04, SA [deleted] of this office and Interpreter [deleted], Abu Ghraib CID, advised [deleted] of her rights, which she waived and provided a statement documenting her abuse by IP [deleted] and denied any knowledge or involvement in attacks against Americans. (See statements) About 1530, 25 May 04, SA [deleted] of this office and Interpreter [deleted], Abu Ghraib CID, advised [deleted] of her rights, which she waived and provided a statement documenting her abuse by IP [deleted] and denied any knowledge or involvement in attacks against Americans. (See statements) About 1730, 25 May 04, SA [deleted] of this office and Interpreter [deleted], Abu Ghraib CID, advised [deleted] of his rights, which he waived and provided a statement documenting his abuse by IP [deleted], and denied any knowledge or involvement in attacks against Americans. (See statements) About 1750, 28 May 04, SA [deleted] interviewed Ms. [deleted] [deleted], Titan Corporation Interpreter, Magistrate Cell, Abu Prison, IZ, who provided a Sworn Statement, relating she speaks with all female detainees every Friday. Ms. [deleted] stated she was familiar with Detainee [deleted] and that she spoke with her on several occasions and at no time did the detainee ever mention that she was abused/assaulted. Further, Ms. [deleted] stated she saw and spoke with the detainee when she first arrived to Abu Prison and that she did not see any bruises or swelling. Ms. [deleted] read the statement provided by the detainee and Ms. [deleted] stated that if that much abuse occurred, she believed she would have seen bruises, abrasions or swelling (See statement) About 1300, 31 May 04, SA [deleted] of this office and Interpreter [deleted] [deleted], Abu Ghraib CID, verbally advised Detainee [deleted] deleted] of his legal rights, which he waived and denied any knowledge or involvement in attacks against Coalition Forces. Detainee [deleted] related he did not know who was responsibe for the attacks. Detainee [deleted] related he was physically abused while at the Palace, he was pulled by his penis, kicked, punched, hit with a hard object and a water bottle was forced up his rectum. He was forced to sign a statement; however, Detainee [deleted] related he did not know how to read or write. Detainee [deleted] related a hood was placed over his head and he could not see anyone. Detainee [deleted] related he was very ashamed of the abuse against him; however, he did not know who tortured him and he did not want to say Americans did it because he could not see anyone. Detainee [deleted] related he heard people speaking English and a man speaking Arabic with a Lebanese accent. He was subsequently transported to an IP station and then transferred to Abu Prison. Detainee [deleted] related he was not abused while at Abu Prison or at the IP Station. Detainee [deleted] related he did not know [deleted] [deleted] or her family and never participated in attacks with them. About 1420, 31 May 04, SA [deleted] of this office and Interpreter [deleted], Abu Ghraib CID, verbally advised [deleted] of his legal rights, which he waived and denied any knowledge or involvement in attacks against Coalition Forces. Detainee [deleted] related he was physically abused while at the Palace. A hood was placed over his head and when he was taken out of the vehicle he was pulled by his penis and forced to stand in one location for several hours. Detainee [deleted] is handicapped and suffers from a bone deficiency. He has several surgery scars and related his bones are very weak. While he was forced to stand, he was punched, kicked and struck with a hard object many times in the kidney area, back and stomach. He was subsequently taken to another location and he heard his sisters in the room. While in the room an unknown person threw a person on the Detainee, which he later found out was his brother [deleted] (NFI). The Detainee related his sisters told him it was his brother and that they thought he was going to die. The Detainee managed to lift up his hood and see his brother who was naked and bleeding severely and had bruises all over his body. The next day an unknown man came and took the Detainee to a hill and kicked him down the hill. The Detainee related he suffered several cuts and bruises to his nose as a result of rolling down the hill. His hood was removed for a short time, when he was at the bottom of the hill, the detainee related he saw a black male, who was wearing US military clothing, of medium height and built and about 30 yrs of age, a white male, short and of medium build and about 30 yrs. of age and [deleted]. The black male asked [deleted] if he saw his brother and told him his brother was dead and that he too was going to die and that he would beat him as not to leave marks so he could not complain about the abuse. The Detainee related he was pulled by his penis, and water was forced up his rectum, he was also punched and kicked several times. He was at the palace for five or six days and abused the entire time, he was subsequently taken to an IP Station where he was informed his brother was brought in dead and six others were brought in tortured. The Detainee related he did not know which IP Station he was taken to. The Detainee related he was not mistreated at the IP Station or while at Abu Prison. The Detainee related he did not witness IP [deleted] do any of the abuse, but IP [deleted] did push the Americans to conduct the abuse. AGENTS COMMENT: The Detainee is handicapped, his legs and arms are not the same length, he has had surgeries on his legs; however they still appeared to be deformed and he had trouble walking. The Detainee related he and his family went to talk to the Americans and they were not captured. He further related that [deleted] had them arrested because his sister refused to pay him money. About 0900, 2 Jun 04, SA [deleted] coordinated with MAJ [deleted] who provided a copy of a list of detainees captured by CJSODF. MAJ [deleted] further related he would provide this office with copies of the detention logs and memorandums in reference to Rules of Engagement pertaining to interrogation. (See list for details) Received Final Information Report from PIT, 75th MP Det (CID), which contained the AIR of SA [deleted] (See AIR) About 1130, 5 Jun 04, SA [deleted] of this office, conducted a site survey of the detention facility which was located in the basement of an adjacent building to the ODA 554 living quarters. The detention room was approximately 12 feet by 10 feet and was empty of any furnishings. There were several chains approximately three feet in length attached to the floor and key type padlocks attached to the end, which was utilized for securing a detainee. It was determined that the length of the chain was sufficient for a detainee to lie down, sit in the up position and reach his head with his/her hands to consume water and food. There was nothing of evidential value during the site survey. SA [deleted] exposed numerous digital photographs utilizing a Kodak Easyshare CX6330. (See compact disc for details) About 1300, 5 Jun 04, SA [deleted] verbally interviewed SFC [deleted] Intelligence Officer, [deleted], ODA 554, B CO, 2nd BN, 5th SFG, Fort Campbell, KY (deployed to Iraq) who stated he has never seen any detainee being abused and he has never abused a detainee. SFC [deleted] stated his unit usually has enough evidence on a detainee that there is no need to force a detainee to talk. SFC [LIAR] stated he has never seen or used a dog for interrogation purposes. SFC [LIAR] stated on one occasion he told Mr. [deleted], Translator, [deleted], Titan Corporation, Fairfax, VA (working in Iraq) to listen at the door outside of the holding cell to hear what the detainees were talking about. SFC [deleted] stated Mr. [deleted] overheard one detainee reassure the other detainee that after they get transferred to the "airport" they would claim they were abused and subsequently released. SFC [deleted] stated he has heard through numerous sources there was a lawyer downtown Baghdad who was telling people to fabricate stories of abuse while they are detained so they will be released. About 1309, 5 Jun 04, SA [deleted] and SA [deleted] advised CPT [deleted] of his legal rights, which he waived and provided a statement where he denied ever witnessing or being involved in the abuse of detainees. CPT [deleted] further stated detainees were provided bread and water while they were detained at the Al-Ademeyah Palace. CPT [deleted] further stated Mr. [deleted] is never present during interrogations. (See certificate and statement) About 1500, 5 Jun 04, SA [deleted] verbally interviewed Mr. [deleted] who stated he has never seen a detainee abused and he has never seen a dog used for interrogation purposes. Mr. [deleted] stated he overheard a detainee named [deleted] (NFI) and [deleted] (NFI) talking about fabricating a story about being abused when they arrive at the "airport" so they will be released. About 1500, 5 Jun 04, SA [deleted] and SA [deleted] advised SSG [deleted] of his legal rights, which he waived and provided a statement wherein he denied ever witnessing or being involved in the abuse of detainees. SSG [deleted] stated he interrogated Mr. [deleted] and used a direct approach technique where he presented intelligence to Mr. [deleted] and he admitted to attacks. SSG [deleted] related he has intelligence which states detainees are being instructed on how to claim abuse while under apprehension to ensure a quick release. SSG [deleted] further related Mr. [deleted] is never present during interrogations. (See certificate and statement) About 1600, 5 Jun 04, SA [deleted], and SA [deleted] advised Mr. [deleted] [deleted] of his legal rights, which he waived and denied ever being present during interrogations of detainees except on one occasion. Mr. [deleted] stated he was asked to sit in a chair when Ms. [deleted] was being interrogated because she said she knew Mr. [deleted]. Her blindfold was removed and she was asked if she knew who the man in front of her was and she could not identify Mr. [deleted]. Mr. [deleted] stated he gathers intelligence on insurgents for the U.S. and is not present for interviews/interrogations. Mr. [deleted] related this family has posted a wanted poster for his death and has attempted to assassinate him twice and he is currently living in the U.S. complex for security. Mr. [deleted] related he has never assaulted the individuals and has never interrogated the individuals. Mr. [deleted] has been working for U.S. forces as an informant since May 03. About 1630, 5 Jun 04, SA [deleted] and SA [deleted] advised Mr. [deleted] of his legal rights, which he waived and denied abusing Mr. [deleted]. Mr. [deleted] stated he is a translator and only remembers translating the statement of Mr. [deleted]'s confession. Mr. [deleted] stated he is never alone with detainees and SSG [deleted was the interrogator for Mr. [deleted] [deleted]. Mr. [deleted] stated he does not recall seeing signs of abuse on Mr. [deleted]. Agent's Comment: Mr. [deleted] will provide a written statement of his own and a translated statement of Mr. [deleted] as soon as possible. Agents were unable to obtain the statements at this time due to imminent threat in the area. About 0945, 6 Jun 04, SA [deleted] interviewed 1LT [deleted] Physician Assistant, CJSODF, who stated she was present during the apprehension of the [deleted] due to the fact females were being apprehended. 1LT [deleted] could not remember the names of the female detainees, but physically screened them and stayed with them during their stay at the Al-Ademeyah Palace. 1LT [deleted] stated she never witnessed them being abused or saw signs of abuse and physically screened them when they were released from Al-Ademeyah Palace. 1LT [deleted] stated she did not complete medical screening forms due to the fact it was not common practice then. 1LT [deleted] further stated she was outside the interrogation room during the female interrogations and the interrogator was a U.S. soldier and not an Iraqi national. About 1457, 11 Jun 04, SA [deleted] intervieweed Mr. [deleted], Interpreter, Titan Corporation, BIAP, who provided a Sworn Statement wherein he detailed his knowledge of the [deleted] family and related he was at the Ademeya Palace when the alleged incident took place. (See statement for details) About 1510, 11 Jun 04, Mr. [deleted] translated the wanted poster pertaining to Mr. [deleted]. "It was rumored lately that the criminal spy ([deleted], the policeman) was killed but now we are sure that he is alive and that is why we call on you to protect your honor and the sanctity of your home to kill this traitor and his associates anywhere you find him so you would cleanse your holy town and God will help you. God is great. Majahdeen." About 1000, 16 Ju 04, SA [deleted] received statements from MAJ [deleted] pertaining to unit members of 2/3 Field Artillery who were present during the 23 Dec 03 detainment of the alleged victims. Statements were provided for the following individuals: SGT [deleted, MAJ [deleted], CW@ [deleted], CPT [deleted], COL [deleted] 1LT [deleted] [deleted] SSG [deleted], CPT [deleted], LTC [deleted] with no indications of abuse ever witnessed. (See statements) About 1113, 16 Jun 04, SA [deleted] briefed CPT [deleted], Chief of Criminal Law, 3rd Corps, Office of the Staff Judge Advocate, Camp Victory, on all aspects of this investigation.
